Mayor Bhalla announces historic acquisition of Union Dry Dock waterfront property

Mayor Ravi S. Bhalla announced today that the City of Hoboken has officially acquired the 5-acre Union Dry Dock waterfront property. Mayor Ravi S. Bhalla announced today that the City of Hoboken has officially acquired the 5-acre Union Dry Dock waterfront property. The City’s ownership of Union Dry Dock will now allow for the development of a park at the site and connect the final piece of an entirely publicly accessible waterfront that has eluded Hoboken for decades.

Mayor Bhalla announced the news to the Hoboken public on social media earlier today, which can be viewed by clicking here.

“Make no mistake about it, the Union Dry Dock property is now in the hands of the City of Hoboken,” said Mayor Bhalla. “This is truly a historic day for our residents, and I’m beyond thrilled that the entirety of our waterfront is now in our control and that we can once and for all plan for public open space and connect our treasured waterfront. This day couldn’t have happened without the steadfast support of our many residents and advocates, including the Fund for a Better Waterfront, who made their voices heard loud and clear that Hoboken deserves nothing less than a waterfront park. I look forward to working with our community on a design our residents can be proud of in the coming months.”

“I would also like to extend my gratitude to Governor Phil Murphy and State Senator Brian P. Stack. Without Governor Murphy’s assistance, New Jersey’s residents would not realize the quality of life and environmental benefits of this acquisition. Without the steadfast support and advocacy of Senator Stack for Hoboken, this acquisition would not have been possible. I also want to thank the Hoboken City Council, which fought alongside my administration and our residents to ensure open space at Union Dry Dock would be a reality. Finally, I want to thank New York Waterway for working cooperatively over the past year with my administration so our residents can realize both a waterfront park, and an improved ferry system in the coming years.”

The acquisition was undertaken in accordance with the condemnation process, which allows the City to move forward with acquiring the unused waterfront property for the purpose of a public park. Pursuant to a Hudson County judge’s order, the City deposited the appraised amount of the Union Dry Dock property, $13.36 million, into Court. The City also recorded a Declaration of Taking with the Hudson County Register. Through these actions, the City has effectively acquired title and ownership of the property. New York Waterway will continue to temporarily occupy the property with the support of the administration, as the City and New York Waterway are working to finalize a temporary lease agreement at the Union Dry Dock property. The lease will assist in the docking of a portion of New York Waterway’s fleet while they redevelop and expand their current ferry operations at an alternate location.

“The fact that the City of Hoboken has acquired Union Dry Dock is an historic turn of events,” said Ron Hine, Executive Director of the Fund for a Better Waterfront. “This site, inaccessible to the public for more than a century, will add more than 3 acres to Hoboken’s waterfront park and complete one of the final missing gaps in a continuous park at the water’s edge first proposed by FBW in 1990. Kudos to Mayor Bhalla and his administration, and all the many community advocates who helped make this happen.”

With control of the Union Dry Dock property, the Bhalla administration will initiate a public planning process to determine the public amenities and features that will be located within the waterfront park. The administration today released a request for proposal (RFP) to solicit professional design firms to present options for the design of a public park at the property. The firm will be tasked with working with the administration and conducting a robust public process that will solicit community input from residents, similar to Hoboken’s other open space projects. The final acquisition price of the property will be determined by the courts, or an agreed to amount if the City and New York Waterway are able to negotiate a final price through the condemnation process.

A lawsuit that will determine the future look of high-rises on Hoboken’s western edge has appeared close to a settlement for a month now and twice has been listed on the city council’s agenda.

But city council concerns about the terms of the deal have put off a vote, and the developers — frustrated by the delays — say their attorney is now preparing to file a motion for summary judgment.

Developer Pegasus Partners filed the lawsuit in November 2021 after the Hoboken Planning Board denied its application for an 18-story, 357-unit building that would sit between Jefferson and Madison streets just south of the 14th Street Viaduct. It also had plans for a 16-story hotel and a residential building of a similar height on separate lots, bringing the project to a total of 958 residential units.

The city had previously approved a version of its redevelopment plan for the area that allowed those heights.

The planning board rejection came after Union City officials pushed back against the height of the buildings, arguing before the board that the high-rises would obstruct certain views from the top of the palisade cliffs. Hoboken Mayor Ravi Bhalla also asked the developer to build lower.

The city administration and council have hit a snag attempting to iron out the settlement, so it has not been put up for a vote yet, Council President Michael Russo said.

“It just seemed like there were certain points that the council wasn’t kind of able to agree on that the lawyers have to go back to,” he said.

A city official said there has been progress on the settlement since it was initially placed on the agenda. But Pegasus Partners Principal Mark Luis Villamar said the council’s objections are about core aspects of the settlement and could be deal-breakers.

“I know it’s going to drag on for a while because the issues the council is raising cannot be dealt with without undermining the entire settlement,” he said.

The settlement would accommodate Union City’s concerns by making the buildings shorter and bulkier, he said, but in exchange the developer wants additional space to build on, an allowance for 200 more residential units and possibly tax abatements.

“I understand how the council would be hesitant to approve things that benefit Union City at the expense of Hoboken, but … we have agreements with the city,” Villamar said.

The lawsuit alleged that Hoboken privately promised Union City officials that it would never approve the building at the taller heights. Pegasus also claimed it would not have gone that far in the planning process if it knew Union City didn’t want buildings that tall.

Contributions to the city, which Pegasus promised as a part of its initial plans, have also been held up while the project has stalled. Those include funding for affordable housing for homeless veterans and for a new pool and community center.
